Terms of Service

These Terms of Service (“Terms”) govern your use of Kovyr (“Kovyr,” “we,” “us”), a security-posture monitoring service operated by Kendall Sorenson. By subscribing to or using the service, you agree to these Terms. If you do not agree, do not use the service.

Kovyr provides scheduled, external (“passive”) monitoring of the internet-facing assets and cloud configuration you authorize, and delivers advisory reports summarizing what it observes. Kovyr identifies and documents potential issues; it does not access, modify, or remediate your systems.

Kovyr provides visibility and documentation only. It is not a guarantee of security, a warranty against breach or compromise, a penetration test, or a formal compliance certification. You remain solely responsible for your own security and for acting on the findings. Reports reflect information available at the time of the scan and may not identify every issue.

You represent and warrant that you own, or are authorized to monitor, every domain and asset you add, and you authorize Kovyr to perform passive checks on them. You are responsible for the accuracy of the information you provide and for implementing (or engaging your own IT provider to implement) any recommended changes. Active scanning (for example, port or exposed-service scanning) is performed only under a separate, signed written authorization.

Subscriptions are billed monthly in advance through our payment processor (Stripe) at the price shown at checkout, and renew automatically until canceled. You may cancel at any time from the billing portal; access continues through the end of the paid period. Fees are non-refundable except where required by law.

Either party may terminate at any time. We may suspend or terminate the service for non-payment or misuse. On termination, your access ends and monitoring stops.

You retain ownership of your data. We handle it in accordance with our Privacy Policy and use reasonable measures to protect it. We do not sell your data.

The service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will detect all vulnerabilities or that findings are complete or error-free.

To the maximum extent permitted by law, Kovyr and its owner will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from a security incident, data breach, or your reliance on the service. Our total liability for any claim will not exceed the fees you paid us in the three (3) months preceding the claim.

You agree to indemnify and hold harmless Kovyr and its owner from claims arising out of your misuse of the service, your violation of these Terms, or your instruction to monitor assets you were not authorized to monitor.

We may update these Terms from time to time. Material changes will be posted here with a new effective date; continued use of the service constitutes acceptance.

These Terms are governed by the laws of the State of Utah, USA, without regard to its conflict-of-laws rules.
